Terms of Use
Effective 15 October 2026
The agreement, and who we are
Right now only this website, its contact form and the Analysis Engine waitlist are open. Accounts, uploads and credit purchases are not open yet. The parts of these terms about them explain how they will work, and we will tell you before anything new opens.
These Terms of Use are the agreement between you and OberBuilt Inc. (“OberBuilt”, “we”, “us”), a company incorporated in the Province of Manitoba, Canada, which runs this site and the OberBuilt Analysis Engine. They apply whenever you use the site: browsing it, joining the waitlist, creating an account, uploading a datalogger file, buying or spending credits, sharing a report, or taking part in our tuner review program.
Using the service means you accept these terms. If you do not accept them, please do not use the service. Where a separate written agreement covers something — for example a reviewer agreement for the tuner program — that agreement governs the subject it covers, and these terms cover the rest. When you accept these terms we keep a record of it, and if we change them and you have an account, we will ask you to accept the new version through the same screen before you carry on. You can withdraw your acceptance at any time from the Terms of Use page in your account. If you do, your account is locked: you will not be able to upload, view results, manage vehicles or buy credits until you accept the current terms again. Nothing is deleted and no credits are taken — your files, your results and your credits stay on your account — and you can still log out, export your data, or delete your account. A lock does not pause anything, though: starter credits keep the expiry date they already had and expire on it whether your account is locked or not. Credits you bought do not expire. We keep a record of both accepting and withdrawing. Withdrawing is not on its own a reason for a refund; see the refund clause below.
Eligibility and your account
You must be at least 18 — the age of majority in Manitoba — to hold an account, or older if the age of majority where you live is higher. Please give us accurate details when you sign up, and keep your email address current — it is how we reach you about your analyses and your credits.
One person, one account. You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has got into it.
For now, the service is offered only to people in Canada outside Quebec and in the United States. We may decline a sign-up, or close an account, if you are somewhere else.
What OberBuilt is — and is not
OberBuilt is a copilot: it analyzes your datalogger file and suggests findings. It does not tune, modify, or fix your vehicle, and nothing it produces is applied to your vehicle by us. A human — you — always makes the final decision about what, if anything, to change.
We are not your mechanic, your tuner, or your engineer. A report is information about one log file, not professional advice, and it is no substitute for a qualified person inspecting the vehicle in front of them. If a report and a professional disagree, trust the professional who can see the car.
What a report can say is limited by what you give it. The analysis reads the log you upload, on the vehicle profile you set up, using the sensors that log actually contains — so a signal your logger never recorded is a signal we cannot comment on, and a profile that does not match your vehicle produces findings that do not match it either. A report describes what was in that log at that moment. It is not a clean bill of health, and it cannot promise that anything is safe.
What we can accept. An upload must be a datalogger CSV of no more than 64 MB, logged fast enough for the analysis to be meaningful. If a log does not meet those limits we tell you and no credit is charged.
Ownership and authorization warranty
By uploading a datalogger file, you warrant that you own the vehicle and the data in that file, or that you are authorized by the vehicle's owner to share it with us. OberBuilt relies on this warranty and does not independently verify vehicle ownership.
We ask you to confirm the same thing every time you upload, in these words:
I own this data, or I'm authorized by the vehicle's owner to share it.
Your logs stay yours. You give us permission to store your upload and process it — including sending it to the OberBuilt Analysis Engine — so we can produce your report, show you your history, and support you if something goes wrong. That permission exists to run the service for you and for nothing else.
Please do not upload anyone else’s personal information. Datalogger files sometimes carry more than engine data, and a log is not the place for a third party’s identifiers. Do not upload anything you obtained unlawfully, and do not upload anything you are not allowed to share.
We use your uploads to improve our analysis only if you opt in. That choice is one setting on your account and applies to the uploads you make while it is on. It is off unless you turn it on, it never changes the report you receive, and you can change it at any time in your account. This is what withdrawing does, in the words we show you when you make the choice:
Withdrawing stops your future uploads from being used for research, and removes your past uploads from research datasets we build from now on. It cannot remove your data from research datasets already built or models already trained.
Credits and purchases
A credit is an entitlement to one analysis run. It is not money, it is not stored value, and it has no cash value. Credits belong to the account they were granted to: they cannot be transferred, sold, or moved to another account.
New accounts receive a small number of starter credits once the email address is verified. Starter credits expire — the number you get and how long they last are shown to you in your account, and the credits you buy do not expire.
Credit packs are sold through our WooCommerce store. The price and any taxes are shown before you pay, and your order and credit history stay available in your account. The store may be closed, or open only to invited members, while we are in a limited launch; when it is closed you will not be able to buy credits, but any credits you already hold keep working.
One thing worth knowing before you close your account:
Any credits left on your account are cancelled with it and are not refunded afterwards. If you bought credits in the last 7 days and have not used them, ask us for a refund before you delete — we cannot do it once the account is gone.
Refund policy
Credits are automatically refunded when an analysis cannot be completed for reasons outside your control: an engine fault, a known engine limitation, a log-format or vehicle-mapping problem we could not resolve, or a problem with the uploaded file itself that our preflight check did not catch. See your credit history for refund records.
If we cannot classify what went wrong, we refund anyway rather than leave you out of pocket. A refund puts the credit back on your account; we do not return money for a credit that was spent on an analysis we completed. If you bought a credit pack and have not used any of it, contact us within 7 days of the purchase and we will refund the purchase. If you think a credit was taken unfairly, contact us — we would rather sort it out than argue about one run.
Withdrawing your acceptance of these terms, or choosing not to accept a new version of them, is not on its own a reason for a refund. Both of the refunds above are unaffected by it: an analysis that could not be completed still refunds its credit automatically, and an unused credit pack can still be refunded within 7 days of the purchase. Outside those two, we do not buy credits back, and withdrawing does not change that. Withdrawing is also not the same as closing your account, which cancels any credits left on it.
Buying online, and your cancellation rights
Buying credits on this site is an agreement made over the internet, so here is everything about that purchase in one place, before you make it.
- Who you are buying from. OberBuilt Inc., a Manitoba company. Our contact details are at the end of this page.
- What you are buying. A pack of credits. One credit entitles you to one analysis run: you upload a datalogger file and we return a report on what that log shows. Credits are not money and have no cash value.
- The price. The price of each pack, the quantity of credits it contains, any taxes, and the total are itemized on the product page and again at checkout before you pay. There are no delivery charges and no recurring charges — a credit pack is a one-time purchase.
- The currency. Prices are shown in Canadian dollars unless the checkout says otherwise, and the currency is displayed with the price at checkout.
- When you get it. Credits are added to your account as soon as your payment completes. Nothing is shipped.
- Getting your money back. The refund clause above sets out when a credit comes back to your account automatically. If something has gone wrong with a purchase, contact us.
Your copy of this agreement. Your order confirmation email and the order record in your account are your copy, and you will have them within 15 days of the purchase. If you did not receive one, ask us and we will send it.
Cancelling. If we failed to give you the information above before you bought, or failed to give you your copy of the agreement, Manitoba’s Consumer Protection Act gives you a right to cancel the purchase and get your money back. To cancel, tell us — an email to the address at the end of this page is enough — and we will refund you. This right is on top of, not instead of, the refund clause above.
The waitlist and admission
While access is limited, you can join a waitlist. Joining puts you on a list and nothing more: it does not create an account, it does not reserve credits, it is not a purchase, and it gives you no right to be admitted. We decide who to admit and when, and we may admit people in any order.
If we admit you, we create your account and email you an invitation. You can leave the waitlist at any time using the unsubscribe link in any waitlist email, which deletes your entry immediately. Everything the service does while it is in limited launch may change — features, prices, and the shape of the product itself — and we may close the waitlist or stop admitting people entirely.
The tuner review program
Experienced tuners can apply to review analyses through our tuner program. Applying is not acceptance: we approve applications at our discretion, and if we turn one down you can apply again after thirty days.
Reviewers see two kinds of work. The first is analyses they uploaded themselves, on their own account. The second is a pool of analyses from other members — and only from members who opted in to let their upload help improve future analysis. Those are shown stripped of anything that identifies the person or the vehicle behind them. If you are a reviewer, treat everything you see in that pool as confidential: do not copy it, publish it, or try to work out whose vehicle it is.
If you submit a correction or an annotation as a reviewer, you give us permission to keep and use it to improve our analysis, including in future versions of the product. We may add a separate written agreement for the program; where it and these terms overlap, that agreement governs.
Acceptable use
Use the service for your own analysis work. Please do not scrape it, hammer it with automated requests beyond your own normal use, try to break or overload it, poke at other people’s accounts or data, take it apart to work out how it is built, or resell access to it.
You remain responsible for your own vehicle and for the law that applies to it. Rules about modifying a vehicle — including emissions and safety requirements — differ by province, state and country, and they apply to you whatever a report says. OberBuilt reports what it sees in a log. It does not tell you to make any particular change to a vehicle, and nothing in a report is permission to operate a vehicle that does not meet the requirements where you drive it.
Intellectual property
The service — the site, the software, the analysis engine, and our names and logos — belongs to us and stays ours. Your data stays yours: your logs, your vehicle profiles, and the notes you write.
The reports we produce for you are yours to use for your own purposes, including with your own clients. Please do not strip them of their context, present them as somebody else’s work, or resell them as a product of their own.
Availability, outages and changes
The analysis engine runs on our own hardware and it will sometimes be down. We built for that: when the engine is unreachable your upload is accepted and queued rather than lost, and it is submitted when the engine comes back. Analyses that cannot be completed release the credit back to you (see the refund clause above).
We may change, add to, or withdraw parts of the service, and we may run maintenance without notice. We do not promise any particular uptime, turnaround time, or that a given feature will still exist tomorrow.
Disclaimers
The service is provided as is and as available. We do not warrant that a report is complete or correct, that it will find every problem in a log, that it will not flag something harmless, or that acting on it — or not acting on it — will keep a vehicle, its occupants, or anyone else safe.
We do not warrant that your vehicle is safe. Nothing we produce is an inspection, a certification, or a warranty of any kind about a vehicle’s condition. To the extent the law lets us, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some of the rights consumer-protection law gives you cannot be excluded. Nothing here takes those away, and where a law of your province, territory, state or country gives you a right we cannot exclude, that right stands.
Limitation of liability
To the fullest extent the law allows, OberBuilt is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost time, or damage to a vehicle or its parts, arising out of your use of the service — even if we were told such damage was possible.
To the fullest extent the law allows, our total liability to you for everything arising out of the service is capped at the amount you actually paid us in the twelve months before the event that gave rise to the claim.
These limits do not apply where the law does not allow them. Nothing here limits liability for fraud, for personal injury or death caused by our negligence, or for anything else that cannot lawfully be limited, and nothing here removes a consumer or statutory right you have that cannot be waived.
Indemnity
If your use of the service causes a claim against us, you agree to cover us for it — our losses and our reasonable legal costs — where that claim comes from your breach of these terms, from your breach of the ownership warranty above, from data you had no right to give us, or from your unlawful use of the service. We will tell you about any such claim and let you take part in defending it.
Suspension, termination and deleting your account
You can stop using the service at any time, and you can delete your account yourself from the Data & Privacy tab in your account. If you would rather not end your account, you can instead withdraw your acceptance of these terms — see “The agreement, and who we are” above. That locks your account but deletes nothing.
We may suspend or close an account that breaches these terms, that is being used unlawfully, or that puts other users or the service at risk. Where it is reasonable to do so, we will tell you why and give you a chance to put it right first.
Some things outlive the account: the ownership warranty you gave for uploads you already made, the licence you gave us for reviewer corrections, the disclaimers, the liability limits, the indemnity, and this clause. What happens to your data when an account closes — including which records we are required to keep — is set out in our Privacy Policy.
Privacy
Our Privacy Policy explains what we collect, why, how long we keep it, and how to get a copy of it or have it erased. Please read it alongside these terms.
Changes to these terms
We may update these terms. When we do, we change the effective date at the top of this page and post the updated terms here. If you have an account, we ask you to accept the new version before you carry on. Anyone else who keeps using the site after a change accepts the updated terms.
Governing law and disputes
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Disputes go to the courts of Manitoba, and you and we each agree to those courts.
If you are a consumer, this does not take away your right to bring a claim where you live, or the protection of the consumer-protection laws of your own province, territory, state or country where those laws say they apply whatever an agreement states. If you live in Manitoba, The Consumer Protection Act (C.C.S.M. c. C200) applies to this agreement and nothing here waives a right it gives you.
